These terms apply when you access or use the EKO Gardening Solutions website. They explain what the website does—and what still needs to be agreed in a written quote or service contract.

This website is operated by EKO Gardening Solutions (ABN 29 987 156 401) in Victoria, Australia. “EKO”, “we”, “us” and “our” mean EKO Gardening Solutions.
The website provides general information about our business, services, previous work and enquiry process. You may use it for lawful personal or business purposes connected with considering or requesting EKO’s services.
2. General information and project examples
Website content is general and may not suit every property. Photographs, case studies, descriptions, timeframes and previous results are examples only. Site condition, access, levels, drainage, weather, materials, approvals, plant health and client choices can change the appropriate method and final result.
We try to keep information accurate and current, but we do not promise that every page will always be complete, error-free or available. Please confirm anything important before relying on it.
3. Enquiries, response times and quotes
Submitting a form, calling, emailing or sending photographs is a request for EKO to review and respond. It is not an acceptance of work, confirmed booking, final price, guaranteed start date or contract.
Our stated 12-business-hour response applies to complete enquiries received during normal operating periods. It refers to an initial response, not necessarily a final quote, site visit or project start. Delays can occur where information is incomplete, demand is unusually high or EKO is unavailable.
A quote is based on the information and site conditions reasonably available when it is prepared. Unless the written quote says otherwise, it may be subject to inspection, measurement, access, product availability and confirmation of the complete scope. A quote remains open only for the period stated in it.
4. Service agreements
Before work begins, the applicable written quote, accepted proposal, work order or contract will set out the agreed services, inclusions, exclusions, price, payment terms and timing. That service agreement takes priority over general website wording if there is any inconsistency.
Changes requested by the client, concealed conditions, inaccurate site information, unexpected waste, unsafe access, weather, material shortages, approvals or work outside the agreed scope may require a variation, revised price or revised timing. EKO will communicate material changes before proceeding where reasonably practicable.
Same-week scheduling is subject to scope, acceptance, access, weather, materials and availability. It is not guaranteed unless expressly confirmed in writing for a specific job.
5. Information and files you provide
You agree to provide information that is accurate to the best of your knowledge and to tell us about relevant access restrictions, hazards, services, pets, tenants, approvals and property conditions. If you provide an address, photograph, plan or other material, you confirm that you are authorised to share it for the enquiry or service.
Do not upload unlawful, malicious or irrelevant files. EKO may decline or delete an enquiry that appears fraudulent, abusive, unsafe or unrelated to our services.
6. Products, plants and materials
Product samples and website descriptions can differ from installed materials because of manufacturing batches, lighting, availability, natural variation and screen display. Specific brands, grades, colours, plant varieties, quantities and manufacturer warranties apply only where they are identified in the accepted quote or service agreement.
7. Third-party services and links
The website may link to or use Jobber, Google, Instagram, Facebook and other third-party services. Those services operate under their own terms and privacy policies. EKO is not responsible for an external service’s availability, content or independent acts, except to the extent responsibility cannot lawfully be excluded.
8. Intellectual property
Unless otherwise stated, EKO owns or is authorised to use the website’s branding, copy, graphics, photographs and layout. You may view and share links to public pages, but you must not reproduce, sell, alter or use substantial website content or EKO branding commercially without written permission.
9. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies a consumer guarantee, right, remedy or liability that cannot lawfully be excluded under the Australian Consumer Law or another applicable law. Services supplied to consumers come with automatic guarantees, including that they will be provided with due care and skill, be fit for an agreed purpose where the law applies, and be supplied within a reasonable time where no time is agreed.
Any limitation or exclusion in these terms applies only to the maximum extent permitted by law.
10. Website availability and security
We may change, suspend or withdraw website content without notice. While we take reasonable care, we do not guarantee uninterrupted access or that the website will be free from every error, virus or security issue. You are responsible for using suitable device and network security.

Personal information provided through the website or an enquiry is handled as described in our Privacy Policy.
12. Changes and governing law
We may update these terms by publishing a revised version on this page.
